Article 1 - Definitions

  1. Student Company: One or more students from an educational institution who, as part of their curriculum, form a company under the legal and fiscal responsibility of Stichting Jonge Honden.

  2. Stichting Jonge Honden: A foundation that enables educational institutions to allow students to participate in the concept of a student company. Stichting Jonge Honden is responsible for financial transactions, insurance, and reporting to the Tax Authority.

  3. Stichting Studentenbedrijf: Responsible for managing the websites www.studentenbedrijf.nl and shop.studentenbedrijf.nl.

  4. Educational Institution: The school or university with which Stichting Jonge Honden has an agreement for offering the student company concept.

  5. Cooling-off Period: The period during which the customer may cancel their purchase.

  6. Users: All visitors to the webshop.

  7. Customers: A person who purchases something without a business-related purpose.

  8. Right of Withdrawal: The customer’s right to cancel a purchase within the cooling-off period.

  9. Distance Contract: A purchase agreement concluded via the internet or telephone.

  10. Withdrawal Form: A standard form that the customer can use to cancel a purchase, included as an appendix to these terms.

Article 2 - Student Company Information

  1. The student company operates under the Chamber of Commerce (KvK) and VAT number of Stichting Jonge Honden.

  2. Stichting Jonge Honden is responsible for the financial, fiscal, banking, and legal actions taken by the student company.

Article 3 - When These Terms Apply

  1. These terms apply to every offer from the student company and every agreement concluded via the internet or telephone.

  2. Before making a purchase, customers can review the terms. If this is not possible, they will receive them digitally so they can be stored.

Article 4 - The Offer

  1. If an offer has a limited validity period or is subject to conditions, this will be clearly stated.

  2. The offer includes a clear description of the product or service. If images are used, they must correspond to the product. Errors in the offer are not binding.

  3. The offer contains all necessary information for the customer to understand their rights and obligations.

Article 5 - The Agreement

  1. The agreement is established once the customer accepts the offer and meets the conditions.

  2. If the customer accepts the offer online, they will receive a confirmation email. If no confirmation is received, the customer may cancel the agreement.

Article 6 - Right to Cancel

  1. The customer may cancel a purchase within 14 days without providing a reason. The student company may ask why but is not entitled to an answer.

  2. The cooling-off period begins on the day the customer receives the product.

  3. For services and digital content, the cooling-off period is also 14 days, starting from the agreement date. If the student company has already incurred costs, the customer must pay these.

Article 7 - Customer Responsibilities During the Cooling-off Period

  1. During the cooling-off period, the customer must handle the product and packaging with care. The product may only be used as it would be in a store.

  2. If the product decreases in value due to customer misuse, the customer may be held liable.

Article 8 - How to Cancel and Associated Costs

  1. If the customer wishes to cancel, they must notify the student company within the cooling-off period using the withdrawal form or another clear method.

  2. The customer must return the product as soon as possible, but no later than 5 working days. This is not required if the student company offers to collect it.

  3. The product must be returned with all accessories and, if possible, in its original packaging.

  4. The customer bears the risk of return shipping.

  5. Return shipping costs are the customer's responsibility.

Article 9 - What the Student Company Must Do Upon Cancellation

  1. The student company will confirm receipt of the cancellation by email.

  2. The student company will refund all costs paid by the customer for the returned product, excluding return shipping costs.

Article 10 - Exceptions to the Right to Cancel
The customer cannot cancel if they have:

  • Ordered a custom-made product.

  • Purchased a product that perishes quickly.

  • Opened a sealed product that cannot be returned for hygiene reasons.

  • Purchased a product that is irrevocably mixed with other products.

  • Opened sealed audio or video recordings.

Article 11 - The Price

  1. Prices in the offer include VAT and will not increase during the offer’s validity, except for VAT rate changes.

  2. Price increases within 3 months of concluding the agreement are only allowed if required by law.

  3. Price increases after 3 months are only allowed if the customer has the right to terminate the agreement.

Article 12 - Quality and Additional Warranty

  1. The student company guarantees that products and services comply with the agreement and legal requirements.

  2. Additional warranty is a promise that goes beyond the student company’s legal obligations.

  3. Additional warranty does not limit the customer’s statutory rights.

Article 13 - Delivery and Execution

  1. The student company will carefully handle the customer’s order and deliver it as soon as possible, no later than 30 days.

  2. If delivery is delayed, the customer will be notified within 30 days and has the right to cancel the agreement free of charge.

  3. The risk of damage or loss of products lies with the student company until delivery.

Article 14 - Payment

  1. The customer must pay immediately via iDEAL unless otherwise agreed.

Article 15 - Additional Rules

  1. The customer is informed that they are purchasing from a student company, which operates differently from a regular business.

  2. The customer should consider this when placing orders, making returns, and communicating.

  5. Teachers from affiliated educational institutions monitor students' compliance with regulations.

  6. Stichting Jonge Honden, Stichting Studentenbedrijf, and the supervising teachers can access customer orders and data to support the student company in their educational activities.
